What Is Collaborative Divorce?
Collaborative divorce is a voluntary process where both spouses, along with their own specially trained attorneys, commit in writing to resolving their divorce outside of court. Instead of adversarial litigation, the process relies on open communication, joint problem-solving, and full transparency to reach an agreement that works for the whole family.
A typical collaborative divorce team may include:
- Two collaboratively trained attorneys — one for each spouse, guiding negotiations and protecting each client's interests
- A neutral financial professional — helping both parties understand and divide assets, debts, and income fairly
- One or two neutral divorce coaches — supporting communication and helping manage the emotional side of the process
- Child specialists, when needed — giving children's needs and voices a place in the conversation
All discussions take place in a series of face-to-face meetings, rather than through formal court filings. If at any point either spouse chooses to go to court, both collaborative attorneys must withdraw from the case — a built-in incentive that keeps everyone committed to resolving things at the table.
